Terms and Condition
The CharlesGate Residence
All Guests who desire to book and make use of the Owner’s residential apartment, located at No. 70 King Perekule Road, GRA Phase II, Port Harcourt, Rivers State, Nigeria and known as The CharlesGate Residence, agree to the terms and conditions herein enumerated.
Now, therefore, the parties agree to the following terms and conditions:
1. Rental Fees & Payment Terms
- The Guest shall pay the full accommodation fee as communicated at the time of booking. All payments must be completed before check-in.
- A refundable security deposit of ₦200,000 applies to all bookings and will be returned after checkout if no damage or policy violation occurs.
- All payments made for accommodation are non-refundable, except when otherwise stated by the Owner.
2. Booking & Check-In Requirements
- Valid Identification: All guests checking in must submit a valid government-issued ID card. This is compulsory for security and record purposes.
- Check-In Time: Standard check-in is 3:00 PM. Early check-in may be granted based on availability.
3. Occupancy & Guest Policy
- Maximum occupancy limits are as follows:
- 2 persons in Studio Rooms
- 4 persons in 2-Bedroom Apartments
- 6 persons in 3-Bedroom Apartments
- Additional guests may be allowed only with prior approval and at a rate of ₦50,000 per extra guest, per night.
- Hosting unregistered guests, unauthorized sleepovers, or visits not previously approved by the Owner is strictly prohibited.
4. Use of Facilities
The Guest is entitled to the use of all amenities provided within the apartment, including Smart TV, WiFi, kitchen appliances, balcony, gym, and access to the swimming pool.
i. Swimming Pool
- Pool hours are 8:00 AM – 8:00 PM daily.
- No late-night swimming is permitted after 8:00 PM for safety and security reasons.
- Guests must follow all pool rules and use the facility responsibly.
- Children using the pool must be supervised at all times.
- The Owner shall not be held liable for injuries resulting from unsafe conduct or disregard of pool safety instructions.
ii. Gym
- Guests may use the gym during designated operating hours.
- Personal trainers are available upon request at an additional cost.
- Guests must use all gym equipment responsibly and adhere to safety guidelines.
5. Events, Parties & Noise Control
- Parties, gatherings, loud events, or social activities of any kind are strictly prohibited within the apartment and on the property grounds.
- Excessive noise, loud music, or disturbances to other residents are not permitted at any time.
- Violations may result in immediate eviction without refund and forfeiture of the security deposit.
6. Property Rules
i. Smoking and Pets
- Smoking indoors, in non-designated areas, and pets of any kind are strictly prohibited.
- A penalty of ₦500,000 applies for violations.
ii. Care of Property
- Guests must treat the apartment and all facilities responsibly, including:
- Maintaining general cleanliness
- Keeping common areas tidy
- Avoiding misuse of appliances or furnishings
iii. Damages
- Any damage or loss must be reported immediately.
- Guests are financially responsible for all damage caused during their stay.
iv. Safety & Electrical Use
- Guests must not use unauthorized or unsafe electrical appliances and must comply with all safety guidelines provided.
7. Parking
- Free parking is available on the premises.
- Guests must park responsibly and must not obstruct driveways or emergency access points.
8. Prohibited Activities
- Illegal or criminal activities
- Tampering with security systems, smoke detectors, or surveillance cameras
- Reckless or dangerous conduct
- Commercial photography, videography, or filming without prior written approval
9. Check-Out Requirements
- Standard check-out time is 11:00 AM.
- Before departure, Guests shall:
- Turn off all appliances and lights
- Secure all doors and windows
- Return all keys to the front desk
- Late check-out may be granted upon request, subject to availability.
10. Liability
- The Owner is not responsible for:
- Loss or theft of Guests’ personal items
- Accidents arising from negligence or failure to follow rules
- Damages caused by power outages, weather, or external service disruptions
- Guests are advised to keep valuables secure at all times.
11. Enforcement & Termination of Stay
- The Owner reserves the right to:
- Refuse entry to any individual who does not comply with identification requirements
- Terminate a Guest’s stay without refund if any terms are violated
- Deduct from the security deposit for damages, violations, or applicable penalties
12. Cancellation & Rescheduling Policy
- Cancellations made more than 72 hours before check-in: No charge (0%)
- Cancellations made within 72 hours to 24 hours before check-in: 25% of total booking value charged
- Cancellations made within 24 hours of check-in: 50% of total booking value charged
- No-shows or same-day cancellations: 100% of total booking value charged
- Rescheduling: Guests may reschedule once without penalty if requested more than 72 hours before check-in.
- Additional reschedules attract the same charges as late cancellation.
- Rescheduled dates are subject to availability.
- Non-refundable bookings: 100% charge applies at time of booking (no refunds or changes)
Note: Non-refundable bookings include all discounted, promotional, and selected peak-period rates. Full payment is required at the time of booking and is not eligible for cancellation, refund, or modification.
13. Acceptance of Terms
By making a reservation, checking in, or entering the premises, Guests acknowledge that they have read, understood, and agreed to these Terms and Conditions.
